Supreme Court Upholds NFU Benefit for Junior Engineers in Landmark BRO Case

New Delhi, July 20, 2026: In a significant judgment benefiting thousands of Junior Engineers across Central Government departments, the Supreme Court of India has upheld the entitlement of Junior Engineers to receive Non-Functional Upgradation (NFU) to Pay Level 9 after completing four years of service in Pay Level 8, subject to seniority-cum-suitability. The verdict was delivered in Union of India & Others vs. Sunil Kumar Rai & Others, dismissing the appeal filed by the Union of India.

Background of the Case

The dispute arose after the Border Roads Organisation (BRO) rejected the claim of Junior Engineers for NFU to Pay Level 9 (Grade Pay ₹5,400 under the 6th CPC equivalent) through a clarification issued on 19 February 2021. BRO argued that the NFU benefit was available only to certain categories of officers and not to Junior Engineers.

The affected Junior Engineers approached the Delhi High Court, which ruled in their favour. The Union of India challenged the decision before the Supreme Court.

Supreme Court's Key Observations

The Supreme Court examined Paragraph 7.4.13(iv)(b) of the Seventh Central Pay Commission, which states that 80% of employees in Level 8 are eligible for Non-Functional Upgradation to Level 9 after completing four years in Level 8 on a seniority-cum-suitability basis.

The Court observed that:

  • Completion of four years in Level 8 is the primary eligibility condition for NFU.
  • The Government cannot impose an additional requirement that an employee must have entered service at Grade Pay ₹4,800.
  • Such an interpretation would amount to adding conditions that are not found in the recommendations of the Seventh Central Pay Commission.

Appeal Dismissed

Agreeing with the Delhi High Court's reasoning and earlier judicial precedents, the Supreme Court held that the denial of NFU to Junior Engineers was not legally sustainable. Consequently, the Court dismissed the Civil Appeal filed by the Union of India, thereby confirming the entitlement of eligible Junior Engineers to NFU under the prescribed conditions.
