In a major step towards strengthening litigation management, the Department of Posts has issued a comprehensive Standard Operating Procedure (SOP) for handling court cases across all Divisions, Regional Offices, Circle Offices and the Postal Directorate. The new guidelines are aimed at ensuring timely legal action, improving coordination among field units, and reducing delays in judicial proceedings.

The SOP has been introduced after the Department observed that delays in filing counter affidavits, appeals and implementing court orders were adversely affecting its legal interests and increasing litigation costs. To address these challenges, the Department has established a structured mechanism with clearly defined responsibilities and timelines for every stage of a court case.
A key focus of the SOP is early resolution of disputes. Field offices have been instructed to dispose of employee representations in a time-bound manner and issue reasoned speaking orders wherever necessary. The objective is to resolve grievances administratively before they escalate into court cases.
The SOP also standardizes procedures for handling matters before Consumer Commissions, the Central Administrative Tribunal (CAT), High Courts, the Supreme Court, and other judicial forums. It specifies the role of Divisional Heads, Regional Offices, Circle Offices and Government Counsel in preparing replies, obtaining approvals, filing pleadings and deciding on appeals within prescribed timelines.
To ensure better monitoring, every level of the Department has been directed to maintain litigation records and conduct periodic reviews of pending cases. Divisions will review cases every month, while Regional and Circle Offices will carry out quarterly reviews of important litigation. The SOP also recommends maintaining digital litigation registers through the e-Office platform for effective tracking of hearing dates, limitation periods and compliance status.
Another significant feature is the emphasis on digital processing of legal matters. The Department has encouraged the use of e-Office, official email, scanned documents, electronic sharing of case records and virtual meetings with Government Counsel to accelerate legal processes and minimize delays.
The SOP further provides detailed guidance on drafting counter affidavits, evaluating legal opinions, identifying priority cases involving policy matters or significant financial implications, and avoiding unnecessary appeals where judgments are already in line with settled legal principles.
With the introduction of this standardized legal framework, the Department of Posts aims to enhance accountability, improve coordination across all administrative levels, ensure timely compliance with judicial directions, and significantly strengthen its litigation management system while safeguarding the interests of the Department.
