India Post Issues SOP for Time-Bound Handling of Court Cases to Reduce Litigation and Ensure Legal Compliance

The Department of Posts has released a comprehensive Standard Operating Procedure (SOP) for Handling of Court Cases to streamline legal proceedings across Divisions, Regions and Circles. Issued by the Postal Directorate on 23 July 2026, the SOP aims to eliminate delays in handling court matters, ensure timely filing of replies and appeals, and protect the Department's legal interests.

The new SOP introduces a structured workflow for dealing with cases before Consumer Commissions, Central Administrative Tribunal (CAT), High Courts, the Supreme Court, and other judicial forums. It fixes clear responsibilities and timelines for every stage—from receiving notices and preparing para-wise comments to filing counter affidavits, appeals and implementing court orders.

One of the major highlights is the emphasis on preventive litigation management. All employee representations on service matters must be disposed of within one month, while policy-related representations are to be referred to the Directorate within seven days. This proactive approach is expected to reduce avoidable litigation.

The SOP also mandates strict adherence to the 30-day timeline for filing counter affidavits, timely appeals against adverse judgments, and processing of legal proposals only through e-Office or official email. It encourages the use of digital communication, scanned documents, virtual meetings with Government Counsel and electronic sharing of case records to speed up legal action.

To strengthen monitoring, every Division, Region and Circle must conduct periodic reviews of pending court cases, maintain litigation monitoring registers, track limitation periods and ensure compliance with judicial directions. Priority treatment has been prescribed for cases involving policy issues, significant financial implications or matters having nationwide impact.

The SOP further lays down detailed guidelines for preparing legally sound counter affidavits, assessing Government Counsel performance, and deciding whether appeals should be filed based on legal merit rather than mechanically challenging every adverse judgment. It also prescribes a standardized format for submitting legal proposals to the Directorate.

With this initiative, the Department of Posts aims to establish a more accountable, efficient and technology-driven litigation management system, minimize delays, reduce unnecessary court cases, and work towards the objective of zero contempt proceedings while safeguarding the interests of the Department.
