Sub:- Regarding Victimization of GDS Employees participated in Strike from 12.12.2023 to 15.12.2023 call given by GDS PJCA by the lower level officers in Divisional and Sub Divisional levels through Issuance of Rule-10B ( Major Proceedings for major penalties) - Request to Intervene in the matter for a congenial end peaceful atmosphere in the country amongst the GDS Employees

Respected Sir,


Your kind attention is invited to refer this Federation letter of even number dtd. 18.12.2023 and Department of Post letter’ order dated 22.12.2023 addressed to all Heads of Postal Circles” on indefinite strike from 12.12.2023 by AIGDSU and NUGDS, in which it has been clearly advised to treat the Strike period on the Principle of "No Work: No Pay” Policy for all ‘employees’ GDS employees participated in the strike.


But, it has been brought to the notice of this Federation that the Divisional and Sub Divisional level officers in almost all circles have issued Charge sheets under Rule-10 B (Major proceedings for major penalty) to many GDS employees including their Divisional Circle/ all India General Secretaries with out paying any heed to DOP order dtd. 22.12.2023 as referred to amongst the entirety of GDS employees for such, as because panic atmosphere has been created amongst them, which doesn't look nice in the eyes if law in a democratic set up of our country . Besides, there should not be any discrimination amongst the GDS unions so far the strike issue is concerned.


The Provision of Rule-23 ( Strike) of GDS ( Conduct and Engagement) Rules, 2020 only ‘may be invoked upon them in the principle of "No Work- No TRCA" Policy for the Striking

GDS employees as per orders issued by G. I, Department of Post's O. M. No. 17-37/2018- GDS, dated the 8th May, 2019.


It is very clearly said in its para -3 of the O. M. that the above action as per paras (i) to (vii) may also be taken without prejudice to any disciplinary action that may be taken against such GDS.


I therefore request your good self and magnanimity to kindly intervene on the matter and advise suitably to all HOCs to withdraw / drop the Proceedings framed under Rule-10 B of GDS ( C.& E) Rules, 2020 (i.e withdrawal of termination notices already issued to GDS staff  in different Circles) and be limited to Rule-23 of GDS ( C&- E) Rules, 2020 for a peaceful atmosphere in the Department across the country, for which the entirety of GDS will be thankful for ever.
