The matter has already been clarified vide this office letter of even no dated 05.11.2020


The terms prosecution and FIR used the relavant rules appear to have one and the same meaning. In case of loss and fraud cases, FIR is required to be lodged. if amount involved is above Rs 50000 and this can be waived by additional PMG (now PMG), inappropriate cases, in accordance with instructions, dated 27.01.1988 However, in respect of the criminal offences other than loss and frauds, including offences under IPO Act, prosecution read as FIR can be waived off by the HOC only
