Representation Raises Concerns Over Non-Implementation of CAT Mumbai Order Since 2016

A fresh representation addressed to the Secretary of the Department of Posts has brought renewed attention to the alleged non-implementation of a judicial order passed by the Central Administrative Tribunal (CAT), Mumbai Bench, in 2016.

The representation, submitted by Shri A.D. Gaikwad of Solapur, Maharashtra, refers to pending proceedings before the Central Vigilance Commission (CVC) and alleges continued administrative inaction regarding the execution of the revised CAT order dated 26 August 2016 in Review Petition No. 29/2016.

According to the representation, the original matter pertains to OA No. 384/2013 before the CAT Mumbai Bench. The applicant stated that despite the revised judgment issued in 2016, the order has allegedly not been implemented by the concerned authorities even after several years.

The communication further mentions a pending CVC Complaint No. 138496/2026 dated 05 January 2026 and Grievance No. DPOST/E/2026/0022278 dated 20 May 2026. The complainant alleged that officials failed to ensure compliance with the tribunal’s order and sought action to prevent loss of public funds.

The representation also cites correspondence issued by postal authorities and vigilance officials, claiming that no effective action has yet been taken regarding the implementation of the CAT ruling.

In the concluding portion of the letter, the complainant alleged violation of Rule 3(1) of the CCS (Conduct) Rules, 1964, and warned of possible legal remedies, including approaching the Hon’ble Supreme Court through a Special Leave Petition or writ proceedings if the issue remains unresolved.

As part of what was described as an effort to observe the “Principles of Natural Justice,” the representation requested the Department of Posts either to challenge the CAT order before a higher judicial forum or to formally explain the reasons for its non-implementation before the CVC.

The matter is currently awaiting an official response from the concerned authorities.
