Government Clarifies Limitation on Amount of Gratuity Under NPS Rules

The Department of Pension & Pensioners’ Welfare (DoPPW), Government of India, has issued an important Office Memorandum clarifying the limitation on the amount of gratuity payable under the Central Civil Services (Payment of Gratuity under National Pension System) Rules, 2021.

The clarification mainly addresses cases where a government employee has already received gratuity from previous military service, State Government service, Public Sector Undertakings (PSUs), or autonomous bodies, and later joins Central Government service.

Key Clarifications Issued by the Government

1. Separate Gratuity for PSU/Autonomous Body Service Allowed

The OM clarifies that a Government servant who had earlier served in an autonomous body or PSU and later joined Central Government service with proper permission can receive gratuity separately for Government service in addition to the gratuity already received from the PSU or autonomous body. 

However, the total gratuity amount will remain subject to an overall ceiling based on total qualifying service and emoluments drawn at retirement

2. Overall Ceiling on Total Gratuity

The Department has clarified that the combined gratuity amount cannot exceed the amount that would have been admissible if the employee had rendered the entire service continuously under the Government and retired on the same pay. 

This provision applies particularly in cases involving:

  • Past State Government service

  • Autonomous body service

  • PSU service

  • Re-employment after previous retirement

3. Big Relief for Ex-Servicemen

One of the major highlights of the OM is the clarification regarding military personnel re-employed in civil service.

The government has clarified that gratuity drawn for military service will not be taken into account for limiting gratuity payable for subsequent civil service under CCS (Payment of Gratuity under NPS) Rules, 2021. 

This means ex-servicemen joining civil posts after retirement from defence services can receive separate gratuity benefits for their civil service without reduction due to military gratuity already received.

Gratuity Ceiling Enhanced to ₹25 Lakh

The clarification comes after the Government enhanced the maximum limit of Retirement Gratuity and Death Gratuity from ₹20 lakh to ₹25 lakh with effect from 1 January 2024 after Dearness Allowance reached 50%. 

The enhancement applies to employees covered under:

  • Central Civil Services (Pension) Rules, 2021

  • Central Civil Services (Payment of Gratuity under National Pension System) Rules, 2021

Why This Clarification Matters

The latest OM removes confusion regarding gratuity entitlement in cases involving multiple services across departments or organisations. It especially benefits:

  • Ex-servicemen joining civil services

  • Employees moving from PSUs/autonomous bodies to Government service

  • Officials with previous State Government service

  • NPS-covered Central Government employees

The clarification is expected to help departments process retirement benefits more smoothly and reduce disputes regarding
