In pursuance of orders contained in Postal Directorate, New Delhi letter no. 2-37/2021-PCC dated 14.07.2022 for implementation of orders dated 11.10.2021 of Hon'ble CAT Bench, Jodhpur in OA No. 290/177/2021, the orders of the Competent Authority are hereby conveyed for grant of Grade pay of Rs. 5400/- on non-functional basis on completion of four years of regular service in the grade pay of Rs, 4800/-. The benefits of enhanced grade pay are granted to the applicants only in personam. The financial up-gradation is granted to the applicants with effect from date mentioned against each :-

1. Shri Mohd. Yusuf Khan,  Supdt. RMS ST Dn., Jodhpur

2 Shri Sohan Lal Bhambhi,  SPOs Chittorgarh

3 Shri S.P. Palod, Chittorgarh.

4. Shri Kailash Giri Goswami, SPOs Bhilwara.

5. Shri D. R. Suthar, the PMG WR Jodhpur.

6. Shri B. R. Bhirania, 

7. Shri Lal Shankar Patel, Alwar

8. Shri R. K. Suthar, Barmer 

9. Shri L. R. Parihar, RMSST Dn., Jodhpur 

10. Shri Deva Ram Purohit, PM Jaipur GPO

11.Shri Ranjeet Singh Shaktawat, Retd. SPOs Chittorgarh. 


The Competent Authority acceded to the claim of above 11 applicants in compliance of Hon'ble CAT Jodhpur Bench order dated 11.10.2021 passed in OA No. 177 of 2021 subject to the law laid down in Union Of India Vs. Tarsem Singh (2008) 8 SCC 648 which, inter alia, restricts entitlement to arrears only for a period of three years preceding to filing the OA.”


2. The financial up-gradation is granted to the applicants only who have filed Original Application No, 290/177/2021 in the Hon'ble CAT Bench Jodhpur. The above financial up-gradation is granted to the applicants purely on personal basis, and shall therefore not amount to functional/regular promotion nor shall have relevance to their seniority position. There shall be no change in the designation, classification or higher status.


3. While implementing these cases, the orders of the Supreme court of india in Tarsem Singh case in Civil appeal No 5151-5152 of 2003 and the Delhi High court order in B K Bhatnagar case in WP No 4861/2021 amy also be kept in view.


4. The applicants may exercise option to get their pay fixed under FR-22(i)(a)(1) at the time of grant of higher pay of Rs 5400/ on non functional basis after 04 years of regular service in the grade pay of Rs 4800/- in pay band PB-2 in view of clarification of Ministry of Finance, Dept of Expenditure UO No 10/1/20.10-IC dated 07.01.2010


5. The applicants shall individually submit the undertaking to the effect that the amount paid in excess due to such financial up gradation, if any, detected at later date shall be recovered from them and shall be kept on record by the DDO concerned.
